Background of the Study
Water resource management has become a crucial issue in many parts of Nigeria, especially as the country faces challenges related to climate change, population growth, and increasing urbanization. In Jalingo Local Government Area (LGA), Taraba State, water scarcity, inequitable distribution, and mismanagement of available resources are prominent issues. Constitutional law in Nigeria, through its provisions on environmental rights and resource management, provides a framework for the sustainable use of water resources. However, the implementation of these laws at the local level is often ineffective, exacerbating water scarcity and inequality.
This study aims to investigate how constitutional law governs water resource management in Jalingo LGA, focusing on the challenges and gaps in the enforcement of constitutional provisions related to water usage, distribution, and protection. The research will analyze the impact of constitutional law on water resource policies, examining the role of local governance in ensuring equitable access to clean water for all citizens.
1.2 Statement of the Problem
Despite constitutional provisions guaranteeing the right to water and environmental justice, Jalingo LGA faces significant water management issues. The mismanagement of water resources, coupled with insufficient legal enforcement, leads to unequal access to clean water, especially in rural areas. This study will identify the legal and institutional challenges that hinder the effective management of water resources and propose solutions for improving the implementation of constitutional water rights at the local government level.

This study will focus exclusively on Jalingo LGA in Taraba State and explore the constitutional frameworks guiding water resource management at the local government level. Limitations may include difficulties in accessing data on water resource management policies and the lack of comprehensive records on enforcement practices.
